그러므로 기술의 사회적 영향을 사전에 평가하고 대응하는 예측적 거버넌스로 ELSI(Ethical, Legal, and Social Implications) 분석이 필수적으로 요구된다.
Abstract
With the revised Advanced Regenerative Bio Act taking effect in 2024, the scope of clinical research and therapeutic applications for advanced regenerative medicine has expanded. Consequently, regenerative medicine is shifting the medical paradigm from traditional symptom-relief-centered care toward fundamental treatments that restore impaired functions. However, due to its technical nature involving living cells and genes, advanced regenerative medicine inherently carries ‘inherent uncertainty’ and ‘knowledge gaps,’ such as long-term effects within the body or delayed side effects. These characteristics create legislative gaps and new risks that are difficult to address solely through existing regulatory frameworks or risk assessment models. Therefore, ELSI (Ethical, Legal, and Social Implications) analysis is essential as a form of predictive governance to assess and respond to the societal impacts of the technology in advance. Accordingly, this study analyzed the issues surrounding advanced regenerative medicine from an ELSI perspective as follows. First, from an ethical standpoint, it confirmed that to address inherent uncertainty, adherence to the ‘best interest and minimal risk’ principle is required. Furthermore, procedures for ‘informed consent’ must be established to prevent patients from mistaking research for treatment, and the integrity and transparency of the research process must be ensured beforehand. Second, from a legal perspective, it examined the legitimacy of ‘risk-based regulation’ to control uncertainty, proposed the necessity of legally mandating ‘long-term follow-up (LTFU)’ to ensure patient safety, and highlighted the challenge of defining the boundary between research and treatment as the scope of permitted therapeutic purposes expands. Third, from a social perspective, it identified limitations in ‘accessibility and distributive justice’ due to metropolitan concentration and high-cost structures, value conflicts and ‘social acceptability’ issues surrounding technologies like gene intervention, and the importance of ‘public communication and information disclosure’ for building trust.
