Abstract
This paper examines the institutionalization debate surrounding Physician-Assisted Suicide (PAS), a recent emerging issue, by outlining potential legal challenges within the current legal framework and proposing rational solutions. It first reviews the key provisions of the “Act on Assisted Dignified Death,” currently pending in the 22nd National Assembly. Regarding the legal issues of PAS, it examines the constitutional aspect, focusing on the conflict between the right to life and the right to self-determination concerning death. Furthermore, from a criminal law perspective, it analyzes the issue that a physician's act of assistance could be evaluated as aiding suicide. It also examines overseas legislative examples concerning the legalization of PAS. By comparing legislative examples from permitting countries like the Netherlands, Switzerland, Germany, Canada, and the United States with non-permitting countries like China and Japan, it concludes that substantive requirements and procedural safeguards determine the success or failure of legalization. Based on this, the paper proposes that the right to self-determination regarding life can be constitutionally protected not only at the point of death but also during the terminal phase. Premised on this, the paper further proposes substantive and procedural requirements as grounds for negating the illegality of the crime of aiding suicide under criminal law. The substantive requirement necessitates the individual's genuine and voluntary intent, thus demanding the free and informed consent of a competent adult. The procedural requirement mandates thorough supervision and control mechanisms to prevent abuse or coercion, including informed consent based on adequate explanation by medical professionals, ensuring vulnerable individuals do not choose death under external pressure. In conclusion, the legalization of physician-assisted suicide can secure legitimacy as the exercise of the constitutional right to self-determination. By fulfilling substantive and procedural requirements under criminal law, it can negate the illegality of the crime of aiding suicide. However, it is proposed that the legalization of physician-assisted suicide cannot overlook the prevalence of a culture that devalues life. Therefore, it must be preceded by a social consensus achieved in parallel with the expansion of hospice and palliative care.
