Abstract

Climate change poses a significant threat to public health through heatwaves, air pollution, and infectious diseases. South Korea has attempted institutional responses through Article 37-3 of the Health and Medical Services Act, but issues regarding legal enforceability, implementation, and accountability remain. This study analyzes the structure and status of South Korea’s climate-health legislation and suggests improvements to enhance its effectiveness. We reviewed the Constitution, laws, local ordinances, and national plans, and compared international regulations from WHO, UNFCCC, and the legal frameworks of the UK, Germany, and Japan. Our findings include: First, the "evaluation and policy formulation" provisions are declarative, with weak enforcement and accountability. Second, unclear authority and responsibility between the Ministry of Environment, the Ministry of Health and Welfare, the Korea Disease Control and Prevention Agency, and the Ministry of the Interior cause governance fragmentation. Third, the lack of a rights-based approach limits remedies for climate health victims. Fourth, the financial foundation is weak, with no stable funding or incentives. Lastly, data governance challenges hinder the integration and legal sharing of health and climate data. Improvements such as formalizing the climate-health policy cycle, establishing dedicated institutions, and creating a climate-health fund are necessary to ensure effective health protection and international alignment.
