첨단재생의료 치료제도 관련 법제의 의의와 향후 과제

2020년 8월 28일부터 시행된 「첨단재생의료 및 첨단바이오의약품 안전 및 지원에 관한 법률」 은 2019년 제정 당시 입법과정에서 정부가 과학적으로 안전성이 증명되지 않은 재생의료를 상업적으로 활성화하려는 것으로 오해할 수 있음을 고려하여 재생의료 시술 내용을 삭제하고 첨단재생의료 분야 임상연구에 관한 내용만 남기는 대안으로 채택된 바 있다. 그러나 2024년 2월 20일개정되어 1년 후 시행을 앞둔 이 법률에서는 ‘첨단재생의료 치료’에 대한 위험도를 구분하여 이를단계적으로 허용하고 있다. 따라서 개정된 법률에서는 첨단재생의료 치료제도 도입과 관련하여첨단재생의료실시기관 지정, 치료대상자 대상 동의 획득, 치료비용 청구, 안전성 모니터링과 이상반응 보고, 기관생명윤리위원회 역할에 관하여 어떤 내용이 변경되었는지 검토하고자 한다. 그리고 이러한 주요 변경사항을 통해 첨단재생의료 치료제도 도입 이후 예상되는 문제점과 제도상한계점은 무엇인지 살펴보고 향후 개선방안을 제언해보고자 한다.
Abstract
The 「Act on the Safety of and Support for Advanced Regenerative Medicine and Advanced Biological Products」, which took effect on August 28, 2020, was adopted as an alternative to deleting the contents of regenerative medical procedures and leaving only the contents of advanced regenerative medicine clinical research, considering that the government may be mistaken for trying to commercially activate regenerative medicine, which has not been scientifically proven to be safe. However, this act, revised on February 20, 2024, and set to take effect a year later, classifies the risk of advanced regenerative medical treatment and allows it to be conducted in stages. Therefore, about the introduction of the advanced regenerative medical treatment system, we would like to review what has changed in the amendment of the act regarding the designation of advanced regenerative medical implementation institutions, obtaining informed consent for treatment subjects, claiming treatment costs, safety monitoring and reporting adverse reactions, and the role of the institutional bioethics committee. And based on these significant changes, we would like to analyze the problems expected after introducing the advanced regenerative medical treatment system and suggest future improvement measures.
