Abstract
The World Health Organization (WHO) has served as the principal institution for setting and coordinating international norms, establishing itself at the core of global health security. Despite intensifying political conflicts and rapid transformations in the global health landscape, the WHO has played multiple roles during pandemic responses—as an operational coordinator, producer and mediator of scientific evidence, and normative advocate for the protection of the right to health and human rights. The success or failure of infectious disease responses depends on transparency in information disclosure, evidence-based policymaking, adherence to the principles of the right to health and non-discrimination, and the establishment of social trust. This study analyzes the structural impact of the United States’ withdrawal declarations from the WHO on the international health order and examines the implications of the two withdrawal decisions in 2020 and 2025 for the institutional and normative foundations of global health governance. By exploring the process of revising the International Health Regulations (IHR 2005), the initial negotiations for the Pandemic Treaty, and the subsequent formation of the WHO Pandemic Agreement adopted under Article 19 of the WHO Constitution, this paper investigates the tensions, power reconfigurations, and institutional transitions facing the multilateral public health normative system. Furthermore, it evaluates the changes in pandemic preparedness and response mechanisms, focusing on the interlinkages, division of roles, normative status, and complementary functions between the revised IHR (approved in 2024) and the WHO Pandemic Agreement (adopted in 2025). While the WHO emphasizes implementation capacity, transparency, rights protection, accessibility, accountability, and equity as key reform principles to restore multilateralism and strengthen international cooperation, its legal enforceability and independent oversight mechanisms to ensure state compliance remain limited. These constraints function as structural barriers to the effectiveness and institutional credibility of international health norms. This paper concludes by analyzing the legal and institutional issues revealed during the domestic implementation of the WHO Pandemic Agreement and the revised IHR 2005. It proposes policy and legislative directions to enhance enforceability and transparency, restructure governance around vulnerability and equity, and reinforce multi-level cooperation among states, the WHO, and private actors.
