코로나19 팬데믹 위기와 보건안보 차원에서의 입법정책적 과제

초록

코로나19 팬데믹을 계기로, 포괄안보적 국가역량의 집중이 요구되고 이는 보건안보 차원에서 감염병 백신, 치료제 및 진단기기의 확보의 중요성이 대두되고 있는 관점에서 군사적 안보의 개념이 아닌 보건안보의 관점에서 비상조치들이 필요하다. 하지만 국내에서는 대통령의 긴급재정명령 등을 제외하고는 보건안보차원에서 백신이나 치료제의 우선확보나 이를 신속하게 개발할 수 있는 재정지원이나 연구기관의 관료적인 제약 없이 지원할 수 있는 조치에 대한 법적 근거가 없는 실정이다. 본 연구에서는 코로나19 위기에 대응하는 보건안보의 개념에 대해 제시하고, 보건안보위기에 대한 필요성을 도출하고 있다. 이에 대한 국가차원의 대응 방안들에 대한 국내외 입법의 현황들을 검토한다. 뿐만 아니라 국방안보 또는 보건위기 대응을 위한 보건안보위기 발생시 국내 우선공급 및 우선확보를 위한 물자조달 및 백신개발 등 관련 조치를 위해 각국의 입법모델을 검토하여 어떠한 조치가 필요하고 이에 따른 입법방향을 도출하고 있다.

Abstract

In view of the increasing importance of securing infectious disease vaccines, therapeutics, and diagnostic devices in terms of health and security, it is necessary to accumulate national capabilities for comprehensive security in the wake of the COVID-19 pandemic and to make emergency measures for responses. However, in Korea, except for emergency financial orders from the president, there is no legal basis for securing vaccines or therapeutics in the first place in terms of health and security, providing financial support to rapidly develop them, or measures that can be supported without bureaucratic restrictions on research institutes in the current situation. In this study, it is presented the concept of health security in response to the COVID-19 crisis, and drawn to the necessity for the health security crisis. The study is reviewing the current status of domestic and foreign legislation on national countermeasures. In addition, in the event of a health security crisis for national defense security or response to a health crisis, the legislative model of each country is looked for relevant measures such as domestic priority supply and procurement of supplies and vaccine development for priority. Accordingly the views of both sides are studied in detail and come to the conclusion that what measures are required and which the legislative policy direction is going.
