코로나19 대응 관련 국제보건규칙의 국제법적 한계와 발전방안 연구

초록

코로나바이러스감염증-19(Coronavirus diseases 2019, COVID19, 코로나19)의 전 세계적인 대유행으로 인해 국제보건규칙(International Health Regulation, IHR)의 기능에 대한 국제사회의 검토와 평가가 진행되고 있다. 본 연구의 목적은 코로나19 대응 관련 국제보건규칙의 국제법적 한계를 도출하고 향후 개선 방안에 대해 제안하는 것이다. 보다 세부적으로는 첫째, 국제보건규칙을 통한 감염병 통제와 코로나19 관련 국제보건규칙의 대응과 기능을 확인한다. 둘째, 국제보건규칙 검토위원회의 국제보건규칙의 코로나19 관리 기능에 대한 평가결과를 토대로 국제사회의 국제보건규칙 개정에 대한 논의사항을 정리한다. 셋째, 국제보건규칙의 국제법적 성격을 규명하고 준국제법으로서의 한계를 도출한다. 넷째, 신종감염병을 대비하기 위한 국제보건규칙의 조약 체결의 필요성과 협약의 내용을 제안한다. 본 연구는 공중보건위기 대응 관련 협약을 포함한 국제보건정책 마련을 위한 근거를 마련하는데 중요한 자료가 될 것으로 보이며 이를 통해 국제보건법학의 향후 방향 설정에 도움을 줄 수 있을 것이다.

Abstract

Due to the global pandemic of Coronavirus Infections-19 (COVID-19) the international community is reviewing and evaluating the function of the International Health Regulation (IHR) 2005. The purpose of this study is to derive international legal limitations of international health rules related to the COVID-19 response and propose future measures. More specifically, first, we confirm the response and function of the IHR(2005) regarding the control of infectious diseases and the COVID-19. Second, based on the evaluation results of the International Health Regulation Review Committee's evaluation of the COVID-19 management function of the IHR(2005), discussions on revising international health rules are organized. Third, it identifies the international legal nature of IHR and draws limitations as quasi-international law. Fourth, it proposes the need to conclude treaties of international health rules to prepare for new infectious diseases and the contents of the Convention. Such analysis is significant in that it can help set future directions for international health law at home and abroad. This study is expected to be an important source in laying the groundwork for international health policy, including agreements on responding to public health crises.
