Abstract
Rousseau calls every state ruled by laws a republic. Rousseau also cites democracy as one of the various forms of government. As a legitimate government of the republic, democracy functions as a minister of the sovereign. The magistrate is tasked with the administration or execution according to the general will as determined by the people. However, the magistrate may attempt to act not as an officer of the people but as their master. In such a transgression of government authority, the body politic must face death. In this regard, the declaration of the extraordinary martial law on December 3, 2024, compels a reflection on the crisis of the democratic republic. This paper derives the characteristics of democracy through an analysis based on Rousseau’s The Social Contract, particularly his discourse on democracy. From this foundation, it examines the current crisis facing democracy in the Republic of Korea through Rousseau’s view, and considers solutions for overcoming such a crisis. In this context, the paper attempts a Rousseauian analysis of the extraordinary martial law on December 3 and a recent incident in which a group of YouTubers violently intervened in a legitimate assembly organized by university students. Although the removal of the president was carried out in accordance with legal procedures, it was the collective voice of citizens gathered in the public square that actualized the impeachment.
