루소 『사회계약론』에서 직접민주주의와 대의민주주의의 양립 가능성 문제

본 논문은 『사회계약론』에서 개진된 루소의 정치철학적 입장을 직접민주주의와 대의민주주의의 양립 가능성의 관점에서 해석하고자 한 시도이다. 이는 루소가 『사회계약론』에서 모순처럼 보이는 두 논변인 직접민주주의의 정당화 논변과 대의민주주의의 정당화 논변을 각각 나름의 근거를 가지고서 제시하고 있음에도 불구하고 이 양자의 관계에 대해서는 구체적인 해명을 제공하지 않는다는 사실에 주목한 데에서 기인한 것이다. 이에 따라 본 논문은 직접민주주의의 정당화 논변과 대의민주주의의 정당화 논변이 『사회계약론』 내에서 양립할 수 있도록 할 유력한 해석을 모색하고자 하였다. 이를 위해 논의는 세 단계로 진행되었다. 먼저, 일반의지의 세 본질적 특성인 양도 불가능성(대표 불가능성), 분할 불가능성, 오류 불가능성에 근거하여 『사회계약론』을 직접민주주의를 정당화하는 논변으로 해석할 가능성을 보여주었다. 다음으로, 정치체제(정부 형태) 및 정치 제도에 대한 루소의 논의에 근거하여, 특히 민주정과 귀족정 각각에 대한 루소의 입장에 근거하여 『사회계약론』을 대의민주주의를 정당화하는 논변으로 해석할 가능성을 보여주었다. 마지막으로, 입법권과 집행권의 권력 분립의 관점에서 해석할 때에 비로소 저 두 정당화 논변이 『사회계약론』 내에서 양립 가능하다는 점을 입증해 보였다. 이에 따를 때, 루소는 입법권의 수립과 기능, 그리고 집행권의 수립의 첫째 단계인 인민의 입헌 행위로서의 법의 제정 행위에 대한 해명에서는 직접민주주의를 정당화하는 논변을 제시한 반면, 집행권의 수립의 둘째 단계인 정부의 지도자의 임명 행위와 인민의 대리인으로서의 집행권의 기능에 대한 해명에서는 대의민주주의를 정당화하는 논변을 제시했다는 점이 입증되었다.
Abstract
The purpose of this paper is to interpret Rousseau’s political philosophical position presented in his Social Contract from the perspective of the compatibility of direct democracy and representative democracy. The necessity of this interpretation lies in the fact that Rousseau presents two seemingly contradictory arguments in his Social Contract, one for the justification of direct democracy and the other for the justification of representative democracy, each with its own basis, but does not provide a specific explanation of the relationship between the two. Accordingly, in this paper, I have sought a most reasonable interpretation that would allow these two arguments to coexist within the Social Contract. To this end, I have conducted this discussion in three steps. First, I have shown the possibility of interpreting the Social Contract as an argument justifying direct democracy based on the three essential characteristics of the general will: inalienability(non-representability), indivisibility, and infallibility. Next, I have shown the possibility of interpreting the Social Contract as an argument justifying representative democracy based on Rousseau’s discussion of political systems(forms of government) and political institutions, especially his positions on democracy and aristocracy respectively. Finally, I have demonstrated that these two arguments for justification are compatible within the Social Contract only when the text is interpreted from the perspective of the separation between the legislative and executive power. In this discussion, I have proven that Rousseau presented an argument justifying direct democracy in the explanation of the establishment and function of the legislative power and the first step in establishing the executive power, which is the enactment of laws as a constitutional act of the people, whereas he presented an argument justifying representative democracy in the explanation of the second step in establishing the executive power, which is the appointment of government leaders, and in the explanation of the function of the executive power as the agent of the people.
