유럽 지역의 '기업과 인권' 규범 발전에서 유럽평의회(Council of Europe)의 역할에 대한 연구

본 논문은 유럽 지역의 ‘기업과 인권’ 규범의 발전 과정에서 유럽평의회의 역할을 연구하는 데 그 목적이 있다. 이를 위해서 논문의 전반부에서는 우선 양차 세계 대전 이후 유럽평의회를 중심으로 유럽 지역 차원에서 형성 및 발전해온 인권 규범에 대한 이해를 위해서, 유럽평의회의 제도적 발전과 유럽인권협약 및 유럽인권재판소의 규범적 발전에 대해 논의한다. 그리고 논문의 후반부에서는 앞서 논의한 내용을 토대로 하여 유럽평의회가 유럽 지역의 ‘기업과 인권’ 규범 발전에 있어 어떠한 역할을 했는지를 구체적으로 논의한다. 이와 관련하여 첫째로 유럽평의회가 기존의 역내 인권 규범들을 적극적으로 해석해내면서 유엔에서 태동한 새로운 ‘기업과 인권’에 대한 국제 규범이 회원국들의 국내 규범으로 확산되는데 기여한 측면과, 둘째로 그러한 과정에서 특히 정보통신기술 분야의 ‘기업과 인권’에 대한 심층적인 규범 발전에 기여한 측면을 중심으로 살펴보고, 결론에서 이것이 주는 학술적 의의와 정책적 함의를 정리한다.
Abstract
This research aims to study the role of the Council of Europe in the development of 'Business and Human Rights' norms in Europe. To this end, in the first half of the research, the institutional development of the Council of Europe and the normative development of the European Convention on Human Rights and the European Court of Human Rights are discussed in order to understand the human rights norms that have been formed and developed at the European level, centering on the Council of Europe after World War II. And in the second half of the research, based on the above discussion, it discusses what role the Council of Europe played in the development of 'Business and Human Rights' norms in Europe. In this regard, first, it actively interprets the norms on human rights that have been formed in the region, and contributes to the spread of international norms born in the United Nations into domestic norms of member countries, and secondly, in the process, it focus on the aspects that contributed to the development of in-depth norms on 'Business and Human Rights' and discuss the academic and policy implications of this in the conclusion.
