Abstract
This study examines the context and process through which the Council of Europe (CoE) is leading a human rights-centered approach to shaping AI governance. It assesses the achievements and limitations of two key outputs: the Framework Convention on Human Rights, Democracy, the Rule of Law and Artificial Intelligence (FCAI) and the Risk and Impact Assessment of AI Systems from the Point of View of Human Rights, Democracy and the Rule of Law (HUDERIA). Since the end of World War II, the CoE has been leading human rights governance in the European region through the European Convention on Human Rights (ECHR) and the European Court of Human Rights (ECtHR). Drawing upon this historical experience, the CoE has been advocating for the establishment of new human rights-centered AI governance at the international level. The resulting FCAI provided an open and flexible regulatory framework with a multi-stakeholder engagement model and a technology-neutral approach. However, it faced limitations such as restrictions on private sector regulation and exemptions for military security. HUDERIA provided a human rights-centered systematic assessment tool, but it faced challenges such as the lack of legal bindingness and the abstractness of the assessment indicators. Notwithstanding these limitations, the CoE's human rights-centered AI governance is an significant milestone in the development of international AI norms.
