Abstract

In the globalized economic situation, corporate activities now transcend national borders, and corporate human rights issues are no longer limited to domestic areas. While multinational corporations exert enormous influence on people in terms of the environment, society, economy, politics, and culture, they also face the corresponding issue of human rights responsibility. However, multinational corporations do not directly bear human rights obligations. They only bear indirect obligations through the state's duty of protection. However, even such obligations cannot eliminate or reduce the gaps related to human rights that arise from business activities that transcend national borders. This paper examines whether it is possible to legally demand direct human rights obligations from multinational corporations based on current international legal documents, what the problems are in indirect human rights obligations mediated by states, whether there is a possibility of expanding human rights obligations, and what method would be an appropriate alternative by examining the (revised) draft of a legally binding document recently prepared by the UN Human Rights Council's working group.
