국제사회에서 환경오염의 심각성이 대두됨에 따라 환경보호를 위한 국제적 차원의 공동 대응방안이 모색되고 있다. 특히 인간의 삶은 환경과 불가분의 관계를 가지고 있고 환경침해로 인한 인권의 침해 가능성에 대한 인식이 대두되기 시작한 1970년대 초부터 환경보호와 인권의 연계에 대한 논의가 본격적으로 시작되어 현재에도 활발하게 진행되고 있다.유럽인권협약과 추가의정서상에는 환경보호와 환경권에 대한 명시적 규정이 마련되지 않았기 때문에 협약체제의 운영초기에는 환경침해를 이유로 한 개인청원이 수리되지 않았다. 그렇지만 협약의 보장기구들이 환경문제와 인권과의 관련성을 인식함으로써 환경문제와 관련된 청원이 수리되어 유럽인권재판소의 판례를 통하여 점차로 ‘환경권’ 또는 ‘환경적 권리’에 대한 보호가 간접적으로나마 이루어지고 있다. 본 논문에서는 지역적 차원에서 가장 실효적이고 발전적 형태로 운용되고 있으며 인권으로서의 환경적 권리의 보장을 가장 활발하게 다루고 있는 유럽인권협약체제를 중심으로 환경보호와 환경권 보호에 대해서 살펴보고자 한다. 먼저 인권과 환경의 연계에 대한 국제적 논의 배경과 유럽인권협약체제에서 환경권보호의 논의배경을 검토한 뒤, 유럽인권협약의 사법적·준사법적 보장기구의 협약적용과 해석을 통한 환경권의 간접적 보호와 그 한계를 판례를 중심으로 분석한다.
Abstract
Human rights and environmental protection are two of the most fundamental concerns of modern international society. They represent different but overlapping social values with a core of common goals. Efforts on behalf of both seek to achieve and maintain the highest quality of human life. In this regard, human rights depend upon environmental protection, and environmental protection depends upon the exercise of existing human rights. At the Universal level, no Human Rights to environment has been already recognised in a general Declaration on Human Rights. In effect, neither the United Nations Charter, the Universal Declaration on Human Rights, nor the International Covenants of Human Rights of 1966, recognize such a right nor guarantee the protection of environment. By contrast, at a regional level, a human right to environment has been proclaimed in Africa, Asian, American and recently, European instruments for the protection of human rights. The European Convention on human rights and its Additional Protocols do not cover any environmental rights or interest in the preservation of the environment. But even though the right to environment had not been listed in the European Convention nor in its protocols, it merited the protection of the European judicial(quasi-judicial) Bodies when theses organs considered it as implicit in the rights and freedoms already guarantee. This paper address the evaluation concerning the Protection of the Rights to Environment under the European Convention of Human Rights System, especially on the base of the European Court of Human Rights Case law.
