유럽인권협약의 사법적 보장에 관한 연구: 최근 변화와 개정작업을 중심으로

제 2차 대전 이후 인권에 대한 국제적 보장체제가 UN을 중심으로 형성되고 있으며 지역적 차원에서도 유럽을 비롯해서 미주 및 아프리카 지역에서 독자적 인권보장체제가 본격적으로 가동되고 있다. 유럽인권협약과 추가로 채택된 의정서에 기초한 유럽인권보장체제는 지역적 인권보장체제로서는 가장 진전된 형태로서 현재 다른 지역체제에 모델적인 기능을 담당하고 있다. 동 체제는 1998년 제 11의정서의 채택으로 협약의 사법적 보장체제의 획기적 개선을 이루었으나 최근 협약가입국과 개인제소의 급격한 증가로 인해 발생되는 사법적 보장체제의 효율성 등을 제고하고자 최근 제 14의정서를 채택하였다.본 논문은 유럽과 국제사회에서 인권의 국제적 보호에 중요한 기능을 담당하고 있는 유럽인권협약과 사법적 보장에 대한 연구로서 최근의 사법적 보장체제의 변화와 개정작업을 중심으로 분석한다. 먼저 유럽인권협약의 채택과정과 전개를 개괄적으로 검토한 후 유럽인권법원의 유럽인권협약에 대한 사법적 보장 메카니즘을 개인제소를 중심으로 분석한다. 마지막으로 최근 유럽인권법원의 사법적 보장체제 운영에 대한 평가와 전망을 한다.
Abstract
Since its adoption in 1950, the European Convention of Human Rights has been amended and supplemented several times. In particular, the control system established by the convention was radically reformed in 1994 with the adoption of Protocol No. 11 which entered into force on 1 November 1998. Protocol No. 11 substituted a full-time single Court for the old system established by the 1950 Convention, namely, a Commission, a Court and the Committee of Ministers Which played a certain judicial role. Protocol No. 11 was intended not only to reinforce their judicial character but also to simplify the system in order to reduce the length of proceedings. But ten years later after the adoption of Protocol No. 11, the urgent need has arisen to adjust the actual system, and particularly to guarantee the long-term effectiveness of the European Court of Human Rights, so that it can continue to play its important role on protection human rights in Europe. In this paper we address the evaluation of the judicial control mechanism and its recent reform of the European Convention of Human Rights by European Court of Human Rights. To this end, this paper consists of four parts. The first chapter describes the historical development of European Human Rights Protection System. The second chapter discuss the judicial protection system of European Convention of Human Rights. Finally the conclusion analyse the recent activities of the European Court of Human Rights and its judicial control on the European Convention of Human Rights.
