Abstract

This article examines the legal framework governing accreditation in medical education through the conflict between the Ministry of Education and the Korean Institute of Medical Education and Evaluation (KIMEE) following the 2024 expansion of medical school quotas. Accreditation in medical education constitutes a core public regulatory mechanism directly tied to national licensing eligibility, quality control of the medical workforce, and public health protection. Nevertheless, the Ministry’s attempt to strengthen prior intervention in major-change standards raised concerns about undue administrative interference with the independence and expertise of the accrediting body. The Seoul Administrative Court’s decision of 12 November 2025 (2024GuHap76966) annulled the Ministry’s prior-deliberation requirement as disproportionate, thereby clarifying the limits of administrative involvement and the standards for judicial review of discretion in accreditation matters. Given that KIMEE is a WFME-recognized accrediting agency whose decisions carry international consequences, institutional autonomy and credibility are indispensable; yet the statutory basis defining the legal status and authority of accrediting bodies remains insufficient. The article argues that medical education accreditation is a vital component of professional self-regulation and public health governance. Essential elements of the system should be codified by statute, while technical standards should remain within the autonomous domain of the accrediting body. A cooperative governance structure among the government, accrediting agencies, and educational institutions is proposed to safeguard both the quality and public accountability of medical education.
