자치경찰제도의 일반적 특성과 형사정책 상의 혁신에 대한 시사점

자치경찰제도는 이제 시행 1년을 넘겨 2년 차에 이르렀다. 현재 국내에서 추진되고 있는 자치경찰제도는 기존의 국가경찰과 비교하여 실질적으로 변한 것이 없는 불완전한 것으로 평가되기도 한다. 이에 이 연구는 여러 가지 문제점이 지적되고 있는 현재 국내의 자치경찰제도가 아닌, 자치경찰제도의 일반적·공통적 특성을 살펴보고 이러한 특성들과 지역사회 경찰활동, 회복적 사법, 절차적 정의, 형사사법 사회복지 등 형사정책상 혁신 이론들과의 관계를 살펴보았다. 본 연구에서 검토된 자치경찰의 일반적 특성은 의사결정 분권화, 신속한 의사결정, 국가적 통제 약화, 지방행정과 결합, 지역 책임성 강화이다. 각 특성들을 고려할 때, 자치경찰제도와의 정합성은 형사정책 상 혁신이론들 중 지역사회 경찰활동이 매우 높은 것으로 확인되었으며, 회복적 사법 및 형사사법 사회복지 또한 상당한 수준의 정합성이 있는 것으로 보인다. 다만, 최근 경찰학 및 범죄학 영역에서 활발히 논의되고 있는 절차적 정의 이론의 경우 경찰제도와 무관하게 적용될 수 있는 이념으로 자치경찰제도와의 정합성이 국가경찰제도와의 정합성보다 높다고 보기는 어려운 것으로 보인다.
Abstract
Including the pilot operation of the self-governing police system, the self-governing police have now passed one year and have reached the second year in Korea. The self-governing police system currently being promoted in Korea is evaluated as incomplete, with no substantial change compared to the existing national police. In this respect, this study examines the general and common characteristics of the self-governing police system, not the self-governing police system that is currently being promoted in Korea, where various problems are pointed out. The relationship with innovative theories or philosophies in criminal policy such as community policing, restorative justice, procedural justice theory, and criminal justice social work was examined. The general characteristics of self-governing police include decentralized decision-making, rapid decision-making, weakened state control, integration with local administration, and strengthening of local accountability. Considering each characteristic, the consistency with the characteristics of self-governing police was confirmed to be very high for community policing. The criminal justice social work and restorative justice also seem to have a considerable level of consistency. However, in the case of procedural justice theory, which is being actively discussed in the fields of police science and criminology, it is difficult to see that the coherence with the self-governing police system is higher than that with the national police system as it is an ideology that can be applied regardless of the police system.
