자치경찰제 시행 후 1년이 경과하였음에도 불구하고 주민체감도와 주민참여가 여전히 낮다는 인식이 여전하다. 현행 광역단위 자치경찰제는 시·도 중심으로 운영되고 있기 때문에 자치경찰위원회는 대부분 시·도경찰청장에 대한 지휘·감독권 행사에 머무르기 쉽다. 이것은 주민참여를 근간으로 하는 맞춤형 자치경찰제 취지와는 동떨어진 제도운영이 이루어지는 원인이 된다. 이 연구는 campbell and marshall이 제시한 주민참여 동기를 살펴보고, 지난 1년간의 자치경찰제 운영성과 가운데 주민참여를 확대하기 위하여 주민의 위상과 역할을 강화해 온 일부 자치경찰위원회의 몇 가지 역점사업들을 고찰하고 있다. 경찰법에 대한 입법론을 언급하기 전에 현행법 하에서 자치경찰위원회의 사무와 권한을 기초자치단체와 주민들이 참여할 수 있도록 보다 유연하게 행사한 사례를 연구·발전시켜 주민중심의 자치경찰제로의 전향적인 변화를 기대하고자 한다.
Abstract
Even though one year has passed since the implementation of the autonomous police system, there is still a perception that the residents' experience and participation are still low. Since the current metropolitan-level autonomous police system is operated mainly by cities and provinces, most of the autonomous police committees are likely to remain in the exercise of command and supervision rights for the heads of city and provincial police. This is the cause of the system operation that is far from the purpose of the customized autonomous police system based on resident participation. This study examines the motivation for residents' participation suggested by Campbell and Marshall and examines some of the emphasis projects of some local police committees that have strengthened the status and role of residents in order to expand residents' participation in the past year. Before mentioning the legislative theory of the police law, we would like to research and develop cases in which the affairs and authority of the local police committee were exercised more flexibly so that basic local governments and residents could participate under the current law.
