에스포지토의 ‘the impersonal’ ―공정의 재배치를 향한 시론―

이 글은 ‘각자에게 몫을 주는 것’이라는 정의관 및 절차적 이론에 입각한 작금의 공정에 대한 이해와 담론은 개인 간의 경쟁적 차원이 지나치게 강조되면서 공통의 삶의 조건을 간과하고 있다는 문제의식에서, ‘the impersonal’의 사유에 의해 공정 논의를 재배치하고자 하였다. ‘the impersonal’의 개념은 정의는 비개인적이며 비인격적이라고 본 시몬 베유에 의해 강력하게 제시된 것으로, 특히 로베르토 에스포지토는 법적·정치적 구성의 기본으로 전제된 人 개념이 재산과 적합성에 기반하여 삶을 위계화함으로써 죽음으로 내몰고 공통성을 외면하는 장치로 작용한다고 비판하며, 人에 근거하지 않은, 비적합한 존재들에 의한 열린 관계의 공동체를 추구한다. 에스포지토의 the impersonal에 관한 고찰은 ‘비정치적’, 즉 종래의 정치신학적 틀에 갇히지 않는 방식으로 다시금 정치를말하고자 하는 노력, 면역을 배제나 방어가 아니라 관계로서 이해하는 것, 일자적이거나 이분적인 대립에서 벗어나 다른 인간 및 비인간의 관계를 모색하는 third person으로 전개되었다. 그러한 비인격적인 것은 몸, 사물, 사유, 제도의 차원에서 드러나는데, 에스포지토는 종래 고유한 개인의 영역으로 생각되어 온 몸과 사유가 실은 다분히 비개인적이며 비인간적인 차원에서 비롯된 것임을 역설하며 그런 맥락에서 사물과 제도를 천착한다. ‘the impersonal’을 실행하기 위해서는 경계에 대한 열린 감각이 요청되며, 그에 따라 면역적 공동체는 열린 공동체로, 죽음정치는 긍정적 ‘삶의 정치’로, 자기생산적 면역적 법은 모든 형태의 삶을 존중하는 ‘삶의 법’ 제도로 변환될 수 있다고 한다. ‘삶의 법’은 人을 근거로 하기보다는 단수적이면서 동시에 복수적인 인간과 비인간의 배치들의 삶의 내재성에서 발현된 규범이 메타제도적으로 전개되는 것을 의미하며, 그러할 때 법제도는 삶의 다양성을 메타적으로 매개하고 연결하면서 갈등을 조율하게 된다. 마지막으로, 기존의 인간의 인식틀은 한계가 있는 만큼, 공정을 말할 때 인간 관점의 권리만 내세우기보다는 바깥을 존중해야 함을 이야기하였다.

Abstract

This paper shows that the recent fairness debate based on the theorem of justice of ‘to each according to his merits’ ignores commune life’s conditions while exaggerating the competitive field among individuals and can be reconfigured by ‘the impersonal’. The concept of ‘the impersonal’ is presented as non human or non-individual by Simone Weil who argues that justice is non-individual and impersonal. Roberto Esposito criticizes that along the proper and property instead of the common, the dispositif of the person operates toward death through the hierarchy of life, and alternatively pursues improper communitas of open relations. He refers the impersonal to ‘the impolitical’, that is the endeavor to understand politics freed from the political theological machine, immunitas as relation rather than exclusion or defense, and not as one or two but third person or non person that seeks relations with other human and non-human beings. The impersonal is performed in the context of body, thing, thought, institution. Esposito emphasizes that body and thought which considered as authentic and individualistic are in fact emerged in impersonal dimensions and such a context treats thing and institution. In order to actualize the impersonal, an open sense beyond border is required. So the conversions like this could be possible: from immunitary community to open communitas, from thanatopolitics to the affirmative politics of life, from the autopoietic immunitary law to ‘the law of life’ respecting every form of life. ‘The law of life’ means that founded on not the person but living person, assemblage of singular plural of human and non-human, unfold meta-mediating law of immanence of lives. And for there are limits of human being’s cognition frame, when saying fairness, we should respect the outside rather prioritize rights of each individual.
