비적합한 정치와 함께 적합한 법을 ― 에스포지토, 랑시에르, 푸코의 경우 ―

“사드와 함께 칸트를”에서 라캉이 말하고자 한 것처럼, 법의 합리적인 작용 및 보편성의 담지는 어쩌면 비적합해 보이고 그간 그리 판단되어 온 예외적이거나 낯선 존재와의 예기치 않은 만남에 의해 가능할 것이다. 최근 팬데믹을 겪으면서 이론의 적실성과 독특성으로 주목받고 있는 에스포지토는 이와 관련해서도 진작에 적합성을 근간으로 한 정치와 법을 비판해 왔거니와, 이 글에서는 그의 사유를 축으로 하여 랑시에르와 푸코의 비적합한 정치에 관한 논의를 살펴봄으로써 역설적으로 법이 더 적합해질 수 있는 방향과 방안을 모색하였다. 에스포지토가 이분법적 구도하에 권능적 결정을 내리는 정치신학적인 종래의 정치가 아닌, 결코 완전히 재현되지 않는 다양성과 갈등이 정치의 핵심임을 비정치적이라는 말로써 담아내고자 했다면, 그래서 정치와 법이 人 장치를 벗어나 비개인적인 차원에서 펼쳐지기를 희망했다면, 랑시에르는 그럴 듯해 보이지만 실은 특정한 방식으로 감각을 분배해 온 것은 치안이며, 정치는 비적합한 이들이 불화로 그 분할을 깨뜨리는 것이라고 한다. 그런가 하면 푸코는 그와 같은 시각과 판단의 정상성은 통치의 규율의 효과임을 지적하는 한편, 비판과 대항품행으로 다른 가능성이 전개될 수 있음을 말한다. 그처럼 비적합한 정치와 함께 한다면 주체성의 지평이 넓어져서 법은 더 보편적으로 될 것이며, 감각이 재편됨으로써 개인적인 차원을 넘어 초개체적인 차원으로 법이 기능하는 등 삶의 다양성이 존중되면서 법은 자유와 공명하게 될 것이다. 이를 위해서는 다른 정치와 정의를 추구하는 움직임들이 조금씩 기존의 장치들을 바꾸어내는 제도화 및 초개체적인 잠재성이 발현되는 발명이 요청되며, 법은 괴물과도 마주쳐 새로운 존재가 됨으로써 다시금 그 과정을 함께 할 것이다.
Abstract
As Lacan said in the essay titled by “Kant avec Sade”, law’s reasonable operation and universality would be possible through the encounter with improper and unfamiliar beings. About that point, Roberto Esposito whose theory is being received attention in pandemic period recently, critiques politics and law based on propriety. In this paper, with examining the discourse of Rancière and Foucault about improper politics on the axis of Esposito’s thought, I seek the direction and method of which law can be more proper. With the term of the impolitical, Esposito shows that the essence of politics reside not in sovereign decision of political theology in the dichotomy frame but rather in never fully representable diversity and conflict. And so he inspires that politics and law unfold in the dimension of the impersonal beyond the dispositif of the person. Rancière says that it is police that assigns sense according the specific ways seemly proper, and contrary to that, politics is the breaking the division with disagreement of improper subjects. And while commenting that the normalities of perspective and judgment are the effect of govermentality and discipline, Foucault argues that the alternative can be possible with critiques and counter-conduct. If accompanying the improper politics, so the field of subjectivity would be enlarged, and law could be more universal, and with the sense reconfigured, law could function impersonal beyond individual, and in the circumstance of the diversity of lives respected, law could resonate with liberty. For that, instituting which means the gradual change of existing dispositif by alternative politics and justice, and invention which means the evolution of transindividual potentialities are demanded. And encountering the monster and becoming new, law will be there again in that process.
