Abstract
Treating Lon Fuller’s discussion as implicitly equivalent to “the rule of law”, “das Rechtsstaatsprinzip”, “procedural theory of natural law”, or “formalism”, prevents a coherent understanding of his conception of law. This article examines that there are certain limitations when understanding Fuller’s argument as a natural law theory in the sense of overcoming legal positivism, and furthermore, his suggestion of famous eight desiderata should not be regarded as a defense for legal formalism or functionalism, or the rule of law in a wide sense. The starting point of Fuller’s legal theory should be understood in his interactive thoughts of eunomics, rather than formalism, functionalism, or a procedural theory.
