국회규칙의 정비와 위원회 규칙 제정의 필요성 연구

본 연구는 국회 상임위원회 운영의 효율성 제고를 목적으로 의사절차에 관한국회규칙을 재정비하고, 이를 활성화하기 위한 방안으로 위원회 규칙에 주목하였다. 제헌헌법은 국회에 의사에 관한 사항을 규칙으로 제정할 권한을 부여하였으나 의사 전반에 관한 규칙들이 국회법에 대부분 규정되면서, 국회규칙은 국회법의 하위체계적 성격을 띠게 되었다. 이에 국회법은 국회운영 전반에 대한 다양하고 방대한 내용을 망라하여 지나치게 일괄적으로 적용되거나, 세세히 규정됨으로써 복잡한 사안들의 특수성을 다루는데 비탄력적이며, 국회규칙은 보조적인절차를 다루는 내용에 한정되었다. 본 연구는 현행 국회규칙의 내용과 범위, 그리고 제⋅개정 절차를 살피고, 위원회 실무자와의 심층인터뷰를 통해 이러한 문제점을 확인하였다. 국회 의사결정에서 나타난 불필요한 갈등을 해결하고, 의사결정과정의 독립성과 효율성 제고를 위해 의사규칙의 정비와 제도화를 고민해야 한다. 주요원칙에 따라 국회법의 내용을 구분하고, 세부 내용들은 국회규칙으로 정하며, 특정 위원회의 정책적 특수성에 따른 유연한 내용을 담은 위원회 규칙제정을 모색해 볼 때이다.
Abstract
This study focuses on the Committee Rules as an alternative to reorganize and revitalize the National Assembly Rules on the purpose of improving the efficiency of the Standing Committee. The National Assembly was authorized by the Constitution of 1948 to enact a rule concerning on the decision-making process. However, as the general rules on the decision-making process were laid down in the National Assembly Law, the National Assembly Rules became sub-systemic of the Law. Therefore, the National Assembly Law covers a wide variety of contents on the general operation of the National Assembly, and it becomes inelastic in dealing with the complex specificity. The National Assembly Rules are limited to those dealing with auxiliary procedures. This study confirms these problems by examining the contents and scope of, and the procedures for enacting/revising the Rules and conducting in-depth interviews with the committee staffs. It is time to consider the institutionalization of decision rules to resolve unnecessary conflicts in legislative decision-making and to increase independence and efficiency in decision-making procedure. Specifically, this study suggests that the contents of the National Assembly Law shall be categorized by the general principles, the details set forth in 국회규칙의 정비와 위원회 규칙 제정의 필요성 연구 ｜ 125 the Rules, and the Committee Rules establish the flexible contents in accordance with the policy areas of specific committees.
