전자감독 대상자의 재범요인에 관한 연구: 판결문 분석 중심으로

성범죄자의 재범 억제의 수단으로 도입된 전자감독제도는 2020년 8월 법의 개정으로 모든 범죄의 가석방자나 조건부 보석 대상 등 전자감독 대상자가 대폭 증가하게 되었다. 법무부의 자료에 따르면 전자감독 제도에 의해 범죄의 재범률은 안정적으로 관리되고 있다고 한다. 그러나, 전자감독 대상자 단 한 명의 재범은 늘 사회적 이목을 집중시키고, 대중의 두려움을 가중시켰다. 반면, 선행문헌은 대부분 성범죄자 위주 연구였다. 따라서, 기존의 성범죄 대상자에서 죄종 전체 전자감독 대상자의 재범에 미치는 영향을 분석할 필요가 있다. 본 연구에서는 최근 5년간 전자장치를 훼손하거나 지시를 위반하여 처분받은 법원의 판결문을 분석하여 전자감독 대상자의 과거 범죄경력과 복역 기간, 전자장치 부착 경험 등의 요소들에 대하여 로지스틱 회귀분석으로 전자장치 훼손 또는 별건 재범에 대한 유의점을 찾아보았다. 본 연구는 공개되는 판결문 특성상 개인정보 등이 비공개되어 인구 사회학적 특성을 고려하지 못한 연구의 한계는 있다. 그러나, 전자감독 관련 연구에서는 한번도 수행된바 없는 판결문을 분석하였다는데 연구의 차별성을 두었으며, 특히, 성범죄뿐만 아니라 일반 죄종 모두 비교 분석을 통해 실천적 대안을 제시 하였다는데 연구의 의의가 있다.
Abstract
The electronic monitoring system, introduced as a means of suppressing recidivism of sex offenders, has led to a significant increase in the number of people subject to electronic devices, because of 2020 reviced rule such as parole for all crimes or conditional bail with electronic devices. According to data from the Ministry of Justice, the crime recidivism rate is stably managed by the electronic surveillance system. However, the recidivism of even one electronic surveillance target has always attracted social attention and added to public fears. On the other hand, most of the previous prior aritcle on recidivism of electronic surveillance subjects were studies focusing on sex offenders. Therefore, it is necessary to analyze the effect on recidivism from existing sex offenders to those subject to electronic device attachment of all crimes. In this study, rulings that have been disposed of for damaging electronic devices or violating instructions over the past five years were analyzed. Through the analysis of the judgment, we looked for points of attention to damage to electronic devices or recidivism by logistic regression analysis on factors such as the past criminal history, prison term, and electronic device attachment experience of electronic monitoring subjects. This study has a limitation in that due to the nature of the judgment that is disclosed, personal information, etc., was private, so the demographic and sociological characteristics could not be considered. However, it is meaningful to study that the judgment that has never been conducted in electronic supervision-related studies was analyzed, and the study presented significant points for comparative analysis not only for sex crimes but also for general crimes.
