최근 우리나라 지역사회 교정(community corrections) 분야에서는 GPS 전자감독 제도를 확대해 “가택구금 방식의 전자감독”을 도입하려는 논의가 진행되고 있다. 2019년 11월에 과밀수용 해소를 목적으로 한 미결수 보석 대상자들에 대한 전자감독 확대 적용이 법률안(대안) 개정 내용으로 다루어지도 했다. 이런 맥락에서 이 연구는 우리나라 전자감독 대상자들의 재범 발생 가능성에 영향을 미치는 핵심 요인을 찾는데 목적이 있다. 전자감독 제도가 새로운 형태의 가택구금제도로 확대되기 전에 미리 관련 요인을 실증적으로 검토해 보고, 특히 범죄자들을 대상으로 발부된 “경고장 발송”이 문제행동과 어떤 연관성을 갖는지 살펴볼 필요가 있다. 이에 2008년 이후부터 2018년까지 우리나라에서 위치추적 전자감독 처분을 경험했던 전체 범죄자 7,922명을 대상으로 해서 어떤 요인이 재범 관련성이 가장 높은지 분석해 보았다. 로지스틱 회귀분석 결과, 일부 인구사회학적 변인과 범죄자 분류급, 경고장 발송횟수가 전자감독 범죄자의 재범 가능성에 유의미한 영향을 미치는 것으로 나타났다. 향후 우리나라에 가택구금 방식의 전자감독이 도입되어 고위험군 전자감독 대상자들을 선별해야 하는 상황이 발생했을 때, 이 연구에서 나타난 재범 관련 변인들이 전자감독 대상자 고위험 평가, 사정 도구 개발에 적극 활용되는 정책이 마련되어야 할 것이다. 이를 통해 향후 지역사회 교정 분야에서 객관적이고 과학적인 근거-기반 교정정책(Evidence-Based Correctional Policy)이 실현되는 기회가 마련되기를 바란다.
Abstract
The study aims at investigating crucial factors that are associated with the odds of recidivism of probationers under electronic monitoring. Warning tickets that are issued by probation officers can play important roles in deterring problematic behaviors of offenders under electronic monitoring. However, few studies have been conducted regarding the relationship between the number of warning tickets by probation officers and the probability of committing additional crimes among probationers under electronic monitoring. The warning tickets of probation officers might result in detrimental outcomes in terms of recidivism of probationers under electronic monitoring. In this context, the current study examined the total 7,922 offenders who had participated in electronic monitoring program from 2008 to 2018 in South Korea. Logistic regression analysis demonstrated that key demographic factors and number of warning tickets are statistically significant factors that could affect the recidivism of offenders un electronic monitoring. Further policy implication will be discussed.
