전자감독 범죄자의 범죄유형 별 재범 시기 비교 연구

이 연구는 전자감독 부착 범죄자를 성범죄 집단과 비성범죄 집단(살인 및 강도)으로 구분하여 두 집단의 재범 발생 시기를 비교, 검토하는데 목적이 있다. 전자감독제도의 효과성을 측정하기 위해 많은 선행연구들이 “재범 발생 유무”에 초점을 맞춰 실험집단과 비교집단 간의 재범률을 비교하는 방법을 취해 왔으나, 더 중요한 것은 범죄자의 재범이 “발생한 시점”을 살펴보는 것이다. 전자장치 부착 이후 범죄자의 재범 발생 시점을 최대한 늦출 수 있다면, 지역사회의 안전도 늘어날 것이다. 법무부의 협조로 2008년부터 2018년까지 우리나라에서 전자장치를 부착했던 범죄자 데이터 7,922명의 자료를 생존분석으로 살펴보았다. 분석 결과, 살인과 강도를 저지른 비성범죄 집단이 강간 등을 저지른 성범죄집단보다 더 빠른 속도로 재범을 저지르는 것으로 나타났다. 재범 발생률을 살펴보면 성범죄자 집단이 더 위험할지 모르나, 재범 발생 시기 차원에서 비성범죄자 집단이 더 빠르게 재범을 저질러 강력한 교정 개입 활동 면에서는 더 빠른 지도, 감독을 요구한다고 볼 수 있다. 범죄유형(살인·강도 집단 vs. 성범죄 집단) 별로 재범 발생 생존확률과 재범 발생 시기가 유의미하게 달라진다고 볼 수 있으므로 지역사회에서 보호관찰관의 전자감독 관련 지도·감독 전략 또한 범죄유형에 따라 달라져야 할 것이다.
Abstract
The present study aims at comparing the different recidivism occurrence timing between sex offenders and non-sex offenders under Electronic Monitoring(EM) program in South Korea. Few studies have focused on the total amount of times before the offenders under EM have commit additional crimes. In this study, data were drawn from the Korean Ministry of Justice in September 2019. This study utilized total numbers of 7,922 offenders who had participated in EM program from 2008 to 2018. Among the total offenders, 1,103 offenders committed additional crimes. Survival analysis demonstrated that non-sex offenders under EM had relatively low rates of cumulative proportion surviving at end, compared to sex offenders under EM. Further policy implications will be discussed.
