보호관찰관의 지도･감독 방법과 재범과의 관계: 전자감독 대상자를 중심으로

전자감독(Electronic Monitoring System)제도의 성패는 대상자에게 부착한 전자장치를 활용하여 담당 보호관찰관이 어떻게 범죄자를 사회에서 효과적으로 지도･감독 하느냐에 달려있다. 이 연구의 목적은 전자감독 보호관찰 대상자의 자료를 활용하여 보호관찰관의 지도･감독 방법과 재범의 관계를 알아보는데 있다. 따라서 이 연구에서는 Ohlin과 동료들(1956)이 제시한 보호관찰관의 지도･감독 방법 모델을 변용하여 우리나라의 지도･감독 방법을 세 가지로 분류하여 분석에 활용하였다. Ohlin과 동료들(1956)의 연구를 바탕으로 보호관찰관의 태도를 복지적 보호관찰, 처벌적 보호관찰, 수동-보호적 보호관찰로 구분지어 대상자의 재범과의 관계성을 알아보았다. 2008년부터 2010년까지 전자감독 보호관찰 대상자 총 957명의 자료를 로지스틱 회귀분석으로 살펴본 결과, 세 가지 지도･감독 방법 중에서 복지적 지도･감독과 처벌적 지도･감독 방법이 재범 발생에 통계적 유의미성을 갖는 것으로 나타났다. 예상과 달리, 복지적 지도･감독은 오히려 재범을 증가시키는 것으로 나타났고, 처벌적 지도･감독 또한 대상자의 재범을 증가시키는 것으로 나타났다. 대상자의 재범을 감소시키기 위해서는 원호･지원과 관련된 복지적 지도･감독 방법 및 경고장 발송과 관련된 처벌적 지도･감독 방법이 재범 방지 차원에서 새롭게 운영되어야 하며, 해당 보호관찰 처우 방법이 현장에서 과감히 개선될 필요가 있다.
Abstract
This study aims at investigating the association between the supervision techniques of probation officers an recidivism of probationer in South Korea. In particular, the present study has purposes of examining the relationship between types of supervision of officers and offenders under Electronic Monitoring System. After newly released from prison, numerous offenders struggle with complicated social problems such as stigma, lower social support, drug abuse, and mental disorder(Chiricos et al., 1972; Stephensmeier & Kramer, 1980; Bahn & Davis, 1991, Cullen, 1994; Lurigio, 1996, 1996; Peatersilia, 2003; Funk, 2004; Tewksbury, 2005). To solve these problems, probation officers have made an tremendous level of effort to provide appropriate probation supervision and support for the offenders who want to adjust to community. This present research study focused on investigating the association between three different types of community supervision methods and recidivism rates of offender by using 975 probationers who were under Electronic Monitoring System from 2008 to 2010. According to the hierarchical logistic regression analysis, there is a statistically significant relationship between “Welfare Worker Method” and probationer's recidivism(B=0.550, P<.001). Furthermore, there is a statistically significant association between “Punitive Officer Method” and probationer's recidivism(B=1.372, P<.001). Further policy implications will be discussed.
