Abstract
This study analyzes Cuba’s foreign investment law and legal framework from a juridical perspective and compares the investment models of multinational corporations to extract strategic implications for Korean businesses entering the Cuban market. Cuba’s 2014 Foreign Investment Law (Ley No. 118) institutionalizes various investment formats, including joint ventures, international economic association contracts, wholly foreign owned enterprises (WFOEs), real estate development, and special economic zones within a controlled socialist regime. Focusing on five major multinational corporations, Sherritt International (mining), Meliá Hotels (tourism), Nestlé (food & beverage), Unilever (consumer goods), and Pernod Ricard (spirits), the study evaluates their investment types, legal structures, and success factors. It also examines how these firms have developed resilient operational strategies in the face of U.S. sanctions. Drawing on these findings, the study offers legal insights and strategic recommendations for Korean companies seeking to invest in Cuba and provides a critical assessment of the Cuban foreign investment regime’s effectiveness and limitations. This research contributes to the comparative legal scholarship on Latin American investment systems and supports Korea’s middle-power economic diplomacy.
