북한의 투자보장협정 참여 가능성 및 국제협력

초록

현재 북미 핵협상이 답보상태이나, 이의 원만한 추진이 이루어진다면 북한은 시장개방을 구상할 것이다. 비경제부문에서 남북의 협력이 조심스레 추진되는 현시점에서, 남북경협 재개 시 이의 지속가능한 운영 방안에 관한 논의가 필요하다. 본 논문에서는 북한의 경제특구 운영과 법제도 방식, 양자간 투자보장협정(BIT)의 현황을 고찰하고, 향후 남북 간 경제협력이 재개될 때, 투자자 보호를 위해 남·북·미 삼자간 투자보장협정 체결이 필요할 것임을 제시한다. 이에 본고에서는 남·북·미가 참여하는 삼국 간 투자보장협정에 각국이 참여한 유인을 분석하고, 협정안 구체화 시 고려되어야 할 사항을 제시하였다.

Abstract

North Korea's nuclear negotiations are currently under way, but if related negotiations are smoothly pursued, North Korea will envision open markets. As the cooperation between the two Koreas in the non-economic sector is promoted, discussions on the sustainable operation of the North-South Economic Cooperation are needed. This paper examines the operation of the special economic zones in North Korea, the legal system method, and the status of bilateral investment guarantee agreements (BIT), and guarantees investment between the two countries to protect investors when economic cooperation between the two Koreas resumes in the future. Suggest that an agreement will be required. Accordingly, this paper analyzed the incentives of each country to participate in the investment guarantee agreement between the three countries in which North and South America participated, and suggested matters to be considered when materializing the agreement.
