2028년 이후 한일대륙붕공동개발협정의 종료 가능성과 중국 변수: 제도화된 협력의 현상변경

본 연구의 목적은 2028년 한일대륙붕공동개발협정 종료 가능성과 맞물려 부상하고 있는 동중국해의 대륙붕 경계획정 및 해양개발문제에 대해 중국 변수가 어떠한 영향을 미칠 것인가를 조명하는 것이다. 2028년 이후 한일대륙붕공동개발협정이 종결되면 양국의 현 공동개발구역에는 무협정의 현상변경 상황이 도래한다. 더욱이 일부 수역에 대해 관할권을 주장하고 있는 중국이 개입함으로써 동중국해의 대륙붕 경계획정과 자원개발 문제는 한･중･일 3국 차원의 문제가 될 것이다. 이러한 맥락에서 본 연구는 제도화된 협력적 현상변경의 관점에서 한일, 중일 간의 기존 합의를 분석함으로써 2028년 이후의 동중국해 대륙붕 경계획정과 자원개발 협상에서 한국 외교가 직면할 과제들을 도출하였다. 협정이 종료될 경우, 한일 양국은 UN해양법협약 제83조에 따라 대륙붕 경계획정을 위한 협상을 진행하게 될 것이다. 한일이 주장하는 권원과 경계기준을 고려하면, 양국은 대륙붕협정 체결 당시의 수역을 두고 협상을 펼치게 될 것이다. 이러한 예측은 이행을 보장할 수 있는 공동개발협정이란 모델의 논의로 귀결될 것이다. 특히 중일대륙붕공동개발구역 합의의 동향을 보면 중간선을 기준으로 한･중･일 3국 간의 대륙붕 경계획정을 둘러싼 협상이 진행될 상황에 대한 대비가 필요하며, 협정 이후 중국에 의한 단독 개발 및 해양 탐사를 억제하기 위한 정교한 제도적 장치를 마련해야 할 것이다.
Abstract
The purpose of this study is to shed light on how rising Chinese variable in the East Asia Sea influence to the demarcation of continental shelf and conflicts over the development of the sea after the termination in 2028 of the Korea-Japan joint development of the continental shelf. After the termination in 2028 of the Korea-Japan joint development, the joint development zone of both countries will become challenging the status quo which has no agreement. In addition, the demarcation of the continental shelf and the development of the ocean in the East Asia Sea will be the Korea-China-Japan conflict because of China’s intervention which states the jurisdiction to the partial coastal zone. In this context, this study derives issues that Korean diplomacy will face from the demarcation and the development of the continental shelf in the East Asia Sea after 2028, through analyzing the existing agreements of Korea-Japan and China-Japan from the perspective of challenging the status quo of the institutionalized cooperation. After the termination of the agreement in 2028, Korea and Japan will proceed with the negotiation for demarcation of the continental shelf per Article 83 of UNCLOS. This prediction will conclude in the discussion over the model of the joint development agreement which assures the implementation. In particular, through observation of the trend of the agreement of the China-Japan joint development of the continental shelf. This study asserts that Korea needs to be prepared for the negotiation over the demarcation of the continental shelf between Korea, China, and Japan and to be prepared the sophisticated institutional mechanism to curb China’s exclusive development and marine exploration after the termination of the agreement.
