Abstract
This study analyzed the major issues in the negotiation process in detail through a review of the negotiations for the conclusion of the Korea-Japan Continental Shelf Agreement and its implications. South Korea and Japan completed the complex issue of joint development of undersea resources in just nine months. It was a complex and difficult issue, both legally and technically, but it was achieved through cooperation between the two countries to realize early development. On the other hand, as the agreement was rushed to realize early development, it was inevitably criticized as hasty. The main problem was that, once the agreement entered into force, no countermeasures were taken if the concessionaire was not designated. In addition, there were two differences in perception in the negotiation process of the agreement. First, Japan placed more emphasis on jurisdiction, while Korea prioritized generating economic benefits through early, smooth development. Second, in terms of development methods, Korea emphasized the active role of the government through the state-led method, while Japan emphasized private-led development and argued that state involvement should be limited. The difference between Korea and Japan’s positions will be clearly revealed in their divergent positions on early development during the joint exploration of the continental shelf.
