Abstract
This study analyzes the reasons why soldiers obey unlawful orders, focusing on the 12・12 military rebellion and the theory of ‘punishment perception error.’ ‘Punishment perception error’ refers to a cognitive error phenomenon in which soldiers perceive the risk of punishment for refusing and obeying an unlawful order as being contrary to objective facts. It refers to a cognitive error state in which soldiers feel that refusing an order poses a greater risk than it actually does, and that obeying an order poses almost no risk, rather than a rational cognitive state based on objective facts. This is not simply an individual problem, but a complex result of institutional, organizational, and psychological factors interacting. This study empirically verifies the theory and proposes defense policy measures to prevent recurrence and strengthen soldiers’ constitutional responsibilities.
