Abstract

The resolution of trade dispute over washing machines between South Korea and the U.S. at the World Trade Organization (WTO) took more than 5 years. The extended duration of this resolution was primarily attributed to the U.S.'s appeal and its subsequent non-compliance with WTO dispute settlement rulings. Paradoxically, this stance from the U.S., a leading advocate of liberal principles and free trade, raises concerns about the legitimacy of international organizations, such as the WTO, which was originally spearheaded by the U.S. This paper aims to uncover the reasons behind the U.S.'s non-compliance with the WTO's dispute settlement decisions. While previous studies have predominantly focused on analyzing state-level factors to explain compliance with international organizations, this research asserts that non-compliance by the U.S. is influenced by domestic political considerations. Through a case study of the washing machine dispute between South Korea and the U.S., we demonstrate that aggressive lobbying by Whirlpool Co. significantly influenced the U.S. government's decision-making process from the outset of the trade dispute. In sum, the interests of domestic stakeholders play a crucial role in determining whether states choose to comply or not with international organizations. To understand the recent protectionist trade policies adopted by the U.S., it is necessary to consider not only the international political structure but also the intricate web of domestic political factors.
