미중 무역전쟁의 해결: 국제질서의 사회화 효과를 중심으로

초록

본 연구는 현재 미중 무역전쟁의 장기화 국면에서 미국과 중국의 국제질서 수호 의지의 변화가 마찰을 해결하는데 어떤 영향을 미치며, 양국이 국제질서에 대해 어떤 입장을 견지하는 것이 사안의 해결에 효과적인지를 분석하고자 한다. 이를 위해 국제정치학의 패권이론과 법사회학적 논의를 활용하여 국제질서 형성과 확산을 살펴본다. 특히 본 연구는 질서를 힘의 분배가 아닌 가치공유와 사회화 과정을 통해 자발적으로 형성된 시스템이라는 점을 강조하는 후자에 초점이 맞춰져 있다. 이를 통해 국제질서가 권력분포 변화 또는 행위자의 목적이나 의도에 의해 쉽게 바뀔 수 없다는 점을 지적하고자 한다. 이러한 측면에서 최근 미국의 사회적 동학을 깨는 행위는 현 국제질서에 대한 신뢰성과 당위성을 손상시키고, 여기서 주도적 역할을 했던 미국의 권위와 정당성까지도 약화시켜 상대국가를 자신이 원하는 질서로 끌어들이는 수단을 무력화시킬 수 있다. 한편 중국은 이미 장기간 국제질서의 학습과 내재화를 통해 내부적으로도 자유주의 국제질서의 축적된 패턴을 수렴하는 사회화 효과를 경험하고 있다. 동시에 현 질서에서 상당한 이익을 누리고 있는 만큼 향후에도 경제질서에서 만큼은 자유주의 질서에 우호적일 수밖에 없다는 추론이 가능하다. 결국 미중 양국이 평화로운 경쟁과 협력을 이어나가기 위해서 미국은 자유주의 국제질서 강화에 노력하여 중국에 대한 실질적이고 효과적인 제재수단을 마련해야 할 것이다. 중국 역시 국제질서를 더 적극적으로 준수하여 미국의 부당한 압력을 방어하고 국제사회 연대를 이끌어 내는 것이 분쟁 해결에 효과적일 수 있다.

Abstract

The purpose of this research is to analyse how the change of the US and China’s will of observing the international order and their standpoints regarding the international order could influence on the resolution of trade war between them. While two theoretical approaches are employed, namely, hegemony theory in international politics and sociology of law, this research gives more emphasis on the latter. This is because sociology of law argues the order is a system automatically formed through the value sharing and socialization effect rather than power sharing. In this sense, this research points out the international order can be easily transformed neither by the change of power distribution nor the intention and aim of the actor. In such point, the United States’ recent act of breaking the social dynamic harms the credibility and justification for the international order. In consequence, the authority and legitimacy of the United States which has led the international order would be weakened and incapacitate the means for attracting the other nation to the desirable order. China has already internally experienced the socialization effect which reflects the accumulated liberal international order through learning and internalizing the international order for a long time. Since China is enjoying the considerable amount of benefit in the current order, it can be inferred that China would be favorable to the liberal order in terms of economic issues. Eventually, in order for the United States and China to continue the peaceful competition and cooperation, the United States needs to work on strengthening the liberal international order with arranging practical and effective sanctions toward China. On contrary, China should abide by the international order more actively to defense against the unfair pressure from the United States and promote solidarity of the international society. It is the way that could be effective for the settlement of disputes between them.
