이 글에서는 대법원이 2013년에 선고한 판결 또는 고지한 결정 중에서 도산법 분야의 주요한 쟁점을다룬 것을 소개하고 논의한다. 이 판결 등에서는 관리인의 제3자성, 채권자대위소송의 중단 및 수계, 사후취득 재산에 관한 담보권의 효력, 과징금 청구권의 면책, 유일한 재산의 처분행위의 사해성, 개인회생절차개시후의 제소 금지 등의 쟁점이 다루어졌다.
Abstract
This article reviews certain decisions rendered by the Korean Supreme Court in theyear of 2013 that dealt with issues in the area of bankruptcy law. Included among those issuesare: trustee as hypothetical lien creditor; stay and succession of creditor subrogation suits; effect ofsecurity interests in properties acquired after commencement of case; dischargeability ofadministrative fines; disposition of sole asset as fraudulent transfer; and prohibition of filingcomplaints upon commencement of individual rehabilitation procedure.
