이 글에서는 대법원이 2011년에 선고 또는 고지한 중요 판결 또는 결정 중에서 도산법 분야의 쟁점을 다룬 것을 소개하고 논의한다. 이 판결 등에서는 개인도산절차의 남용, 포괄적 금지명령의효력 범위, 예약형 집합채권 양도담보의 부인, 담보권 실행행위의 부인 등의 쟁점이 다루어졌다
Abstract
This article discusses and analyzes certain decisions rendered by the Korean Supreme Court in the year of 2011 that dealt with issues in the area of bankruptcy law. Those issues include: abuse of consumer bankruptcy proceedings ; scope of the effect of conclusive prohibition orders ; avoidance of floating liens on accounts receivable ; and avoidance of execution of pledge.
