이 글에서는 대법원이 2014년에 선고한 판결 또는 고지한 결정 중에서 도산법 분야의 주요한쟁점을 다룬 것을 소개하고 논의한다. 이 판결 등에서는 임금 채권자의 회생절차 개시신청권, 관리인을상대로 한 사해행위 취소, 파산선고후 임금에 대한 지연손해금 채권의 성격, 특별이익 제공행위, 법원의 강제인가 의무 등의 쟁점이 다루어졌다.
Abstract
This article reviews certain decisions rendered by the Korean Supreme Court in theyear of 2013 that dealt with issues in the area of bankruptcy law. Included among those issuesare: right of wage claimants to file an involuntary petition for reorganization; revocation offraudulent transfers made to a bankrupt debtor as against its trustee; nature of damages for latepayment of wages after bankruptcy order; provision of special benefits; and court’s duty to make“cramdown.”
