제 2 공화국 내각제의 불안정에 대한 정치제도적 평가

이 글은 제 2 공화국의 정치적 불안정의 원인을 내각제라는 통치구조의 작동 원리와 관련하여 논의한다. 이 글에서는 제 2 공화국 내각제의‘정상적 작동’을 어렵게 한 제도적 요인으로 대통령의 잘못된 역할 설정과 제도적인 차원의 정치적 갈등 해소의 실패 등 두 가지 점을 지적하고자 한다. 대통령 요인에 대해서는 대통령과 총리의 그릇된 관계 설정이 제 2 공화국의 내각제가 불안정하게 된 매우 중요한 원인이었으며, 정파적 속성에서 벗어나지 못한 대통령의 존재가 애당초 내각제가 전제하고 있는 제도적 운영 원리에서 벗어나게 만들었다는 것이다. 상호의존의 체제인 내각제는 정치적 혼란과 대립이 지속되면 내각 불신임이나 의회 해산을 통해 이러한 문제를 해결하도록 하고 있다. 그러나 제 2 공화국에서는 이러한 근본적인 정치적 갈등 해소의 방안을 활용하지 못한 채 장기적인 정치적 불안정을 방관함으로써 군부 개입의 빌미를 제공한 것이다.
Abstract
This paper explores the reason for the collapse of the Second Republic in South Korea. This paper argues that the fall of the Second Republic is attributed to the failure of some institutional prerequisites for the cabinet system. This paper pays attention particularly to the role of the president and the prime minister. The president, who was supposed to be politically neutral, was continuously involved in politics as a partisan leader, coming into conflict with the prime minister. A deeply divided party won a landslide victory in the founding election in 1960, and failed to create an outright winner. This paper argues that the prime minister should have dissolved the National Assembly and called a snap election to calm the political conflicts. The downfall of the Second Republic is ascribed to major political actors who did not appropriately understand the working mechanism of the cabinet system, not to the parliamentary system itself.
