본 연구의 목적은 현 우리나라의 학교영역에서 학생신분인 아동⋅청소년의 정치적 참여가 어떻게 실현되고 있는지를 분석하고, 이를 통해 아동⋅청소년의 주권자이지만 유예된 시민으로서 정치적 참여를 배제키고 있는 문제를 살펴보고자 하였다. 특히 학교영역에서의 아동⋅청소년은 ‘현재의 시민(being citizen)’으로서 지위 보다는 ‘성장하는 시민(becoming citizen)’으로서의 지위를 강요받고 있다는 것을 알 수 있었다. 이것은 헌법과 유엔아동권리협약에 의하여 보장된 정치적 참여권을 ‘교육목적’하에 학교규칙을 통하여 광범위하게 제한하고 있다는 사실을 통해서 확인할 수 있었다. 이와 같은 현상은 현행 우리나라에서 시행되고 있는 사회적⋅법제도가 아동⋅청소년을 보호의 객체로 규정함으로써 아동⋅청소년이 구조적으로 주체로서의 지위를 현실화 시키지 못하고 있다고 여겨진다. 그러므로 아동인권을 보다 현실에서 구체화시키기 위해서는 아동 스스로가 국가 공동체의 일원으로서 의사결정구조에 참여하여 본인의 이익을 보다 적극적으로 반영할 수 있도록 하는 사회⋅법제도적 구조의 변화가 선결될 필요가 있다는 것을 강조하고자 하였다. 학교영역은 아동⋅청소년들이 생애기간 중 특정기간을 보내는 곳이다. 또한 이곳은 아동⋅청소년이 ‘좋은 시민성’을 함양하는 장이기도 하다. 그렇기 때문에 학교영역에서는 아동⋅청소년의 정치적 참여를 제한하는 것이 아닌 시민교육의 일환-참여를 통한 시민성 함양-으로 적극 조장하는 장으로서 기능해야 할 필요가 있다.
Abstract
The purpose of this study was to analyzed how being realized children and youth’ political participation of current as status of student in the area of our schools, and through this, was to looked at the problem that is exclusion of political participation of children and youth, although the sovereign but deferred a sovereign citizen. Especially, I knew that in the area of schools, children and youth forced to status of as becoming citizen rather than status of as being citizen. That was confirmed that there is broad restrict the political participation rights guaranteed by the Constitution and the UN Convention on the Rights of the Child through the school rules under the’educational purpose’. that is, Being implemented, especially as the current social and legal system defined as the object of protection of children and youth structurally do not realize that the position as the subject. Therefor, I would like to emphasize that change of the institutional structure of the society and the law that child’s own country as a member of the community to participate in the decision-making structure more aggressively to reflect is a need to be prerequisite change in order to materialize the Rights of the Child more in reality The area of schools is where children and youth spend a certain period of life. In addition, there is also a place where children and youth learn’good citizenship’. so the area of schools is a need to function as a place to actively promote part of the civic education- citizen involvement through participation- and not to restrict the political participation of children and youth.
