지방자치법의 시･군･구 특례 제도와 분권 전략의 변화: ‘주어지는’ 분권에서 ‘획득하는’ 분권으로

초록

본 논문의 목적은 2022년 개정 지방자치법에서 규정한 시･군･구 특례 제도의 의미를 지방분권 전략의 차원에서 검토하고 제도적 개선방안을 모색하는 것이다. 가장 유사한 사례인 북유럽 국가의 자유지방정부에 대한 검토를 통해 시･군･구 특례 제도가 모든 지방정부에 적용되는 권한을 획일적으로 이양해 왔던 기존의 ‘주어지는 분권’ 방식에서 개별 지방정부의 역할을 강조하는 ‘획득하는 분권’ 방식으로의 전환을 의미하며, 차등 분권을 통해 분권의 딜레마를 극복할 수 있는 대안적 분권 전략이 될 수 있음을 주장한다. 그러나 이 제도가 정치적 수사에 그치지 않고 실질적 효과를 거둘 수 있는 분권 전략이 되기 위해서는 범정부 차원에서의 분권 정책 수립과 입법적 보완이 필요하다는 점을 지적한다.

Abstract

The purpose of this paper is to explore the policy implications of the asymmetric decentralization program for local self-government stipulated in the revised Local Autonomy Act of 2022. The review of the free communes experiments in Nordic countries which is very similar to this program suggests that the asymmetric decentralization program can be an effective solution for the so-called the issue of dilemmas of decentralization in Korea. Given the situation of the Korean local self-government, the asymmetric decentralization implies a shift of the devolution strategy from the decentralization ‘given’ to all local governments toward the unequal decentralization ‘acquired’ by individual local governments. However, the program must be executed as a part of decentralization masterplan and be supported by legal provisions to create a substantial effects. Otherwise, it is highly likely to be nothing more than a political rhetoric.
