Abstract

This Thesis’ title is “An overview of Constitutional direction of study onwelfare for old people in ageing society.” The growing number of aged peopleis causing lot of societal and economic problems. Especially, as populationageing comes with low fertility and support for the old people from familymembers which has been originally from full-time housewife is substantiallydiminishing, the whole society desperately needs taking comprehensive,systematic and effective actions for welfare for the aged. Till now, discussionsabout senior citizens and their welfare have been taking place in the field ofsocial welfare studies or welfare studies for the old. Discussions in the field ofconstitutional study, even though it is the legal base of welfare for seniorcitizens, have been almost nil except some fragmentary introductions aboutsenior citizen's welfare related laws. This, I think, comes from wrongunderstanding on the whole legal system in which constitution law is at thesummit. Sure enough, the discussions about welfare of the aged inconstitutional study need scholarly help from adjacent or neighboring studieslike social welfare studies and so on. But, even though, there are no changesin the fact that constitution must be a debating base for welfare of the seniorcitizens in ageing society. The reason is that most of welfare plans andpolicies for the aged are now in force according to related legislation and therelated legislation should be based on constitutional law. Consequentially,study on welfare of the aged in ageing society should take first step inconstitutional perspective. This thesis started with these questions at issues. This is about fundamental study on welfare of the aged in rapidly ageingsociety which is almost wasteland in constitutional study. Lastly, this articleprovides pratical and attainable constitutional directions of study on welfareof the aged to take root in a big change of ageing society.
