헌법개정과 연령통합 - 노인 기본권 실현을 위한 대안적 헌법 패러다임의 모색 -

고령사회에 진입한 우리 사회 현실을 고려하면 노인 기본권 문제는 헌법개정의 절차적 방식을 동원하여야 할만큼 급박한 주제이다. 또한 심각한 고령사회라는 상황 조건에 따른 연령 및 세대 간 사회통합 문제는 헌법에서 직접 다루어야 할 정도로 중요하다. 기본권 분쟁의 궁극적 해결 지침으로 비례의 원칙과 이익형량을 채택하고 있는 이상, 우리 사회의 인적구조가 급변하고 있는상황에서의 기본권 규정과 해석은 기존의 것과 달라질 수밖에 없을 것이다. 이들 심사기준이 본질적으로 상대적 개념일 수밖에 없기 때문이다. 특히 국가로부터의 급부청구권을 요하는 적극적 기본권의 경우 그 상대성은 매우 중요한 판단 형식으로 기능하게 된다. 그러나 노인 기본권에 대한 현재의 헌법적 패러다임을 그대로 유지하는 한,그 실질적 규범력 확보의 길은 요원하다는 것이 이 글이 전제하는 문제의식이다. 또한 초고령사회를 향해 급격히 변동하는 과정 속에 있는 우리에게 연령의 측면에서 사회통합을 위한 헌법적 조치는 그 어느 때보다 절실히 필요하다고 생각한다. 소위 “연령 분절적(age-separated)” 구도를 유지하게 되면 노인 기본권을 복지정책에 근거한 사회적 기본권으로 정의할 수밖에 없고, 동시에 사회적 기본권의 태생적 한계 또한 극복할 수 없다. 윤리적 강제를 바탕으로 한국가의 적극적 역할에 기댈 수밖에 없는 기본권 이론구성으로는 더 이상 당면한 고령사회 및 초고령사회의 심각한 위기에 대응할 수 없다. 따라서 이제 다양한 연령이 서로 통합적으로 공존하는 바탕 위에서 신체적 능력이 저하되는노인층을 위한 복지 체계를 확충하여야 한다. 이런 의미에서 최근 사회복지학계 및 노인문제에 관한 사회과학 연구에서 제기되는 ‘연령통합(age-integrated)’의 개념을 헌법적으로 흡수하는 것은 충분히 모색할 만한 가치가 있는 일이다. 연령통합이란 연령을 이유로 한 사회진입장벽을 없앰으로써 각 연령 간활발한 교류가 이루어질 수 있도록 함을 추구하는 인구학 및 사회학 이론을말한다.
Abstract
Considering the current status of the Korean society categorized into “agedsociety” recently, the elderly right is imminent to practically perform through aconstitutional revision. In addition, social integration including age-related andgeneration-related cohesion under aged society is one of the serious problems tosolve in the Constitution. As long as the Constitutional Court of Korea takesproportionality and balancing for deciding the rights disputes, the changedcomposition of population in our society should make a difference in legal decisionmakings. That is because those tests in courts does not presuppose a fixed concept. Particularly the positive liberty, such as entitlements, takes relativity of those testsmore serious for decision. However, the writer insists that if we stick to the current constitutional paradigmfor welfare rights, their performance cannot be practically fulfilled. In the Koreansociety that plummets to “hyper aged-society”, constitutional actions for socialintegration, especially age-integration, are needed urgently. Under the age-separatedparadigm, the elderly rights cannot be practically performed based on the welfarerights that could not be realized unless the state actively works. Therefore, thewelfare policies should be performed on the foundation that all generations arecoexisting with integrity. In this sense, this article tries to accept the concept ofage-integration that is strongly researched in the social welfare studies and sociologyfor constitutional discourse.
