본 논문은 미국 연방 상원의회의 의사진행방해제도를 중심으로, 의사진행방해란 무엇이며, 어떻게 변화하여 왔는지, 발생 요인은 무엇인지를 역사적․실증적 접근을 통해 연구한다. 그 결과 미국 의회에서 의사진행방해는 의사규칙의 틈새를 활용해 영향력을 강화하려는 소수의 전략적 행위에서 나타났으며, 이후 원안 그대로 유지하려는 소수파의 전략과 이를 무력화하기 위해 의사규칙․절차의 개정을 추진하는 다수당의 의회 주도권 강화 전략이 지속적으로 충돌․타협하면서 점진적으로 변화하였음을 발견하였다. 본 논문은 실증적 분석의 차원에서 개별 의회의 의사진행방해 빈도 변화와 의회정당의 내외적 역학, 의회제도의 유인구조 관계를 검증한다. 음이항 분포 회귀분석 결과 개별 의회의 의사진행방해 제기빈도는 의회정당 내 구성원의 이념적 동질화의 정도와 다수당과 소수당의 이념적 간극의 차이, 그리고 의사진행방해 대상법안에 대한 의사일정조정제도의 도입에 따른 유인구조 변화에 영향을 받는 것으로 나타났다. 상원 내 소수집단의 의사진행방해 제기는 다수당의 힘이 강하거나, 다수당과 소수당의 이념적 간극이 크지 않을 때, 소수가 의사진행방해를 함으로써 동료나 조직에 지우게 되는 물리적․심리적 부담이 클 때, 그 빈도가 줄어드는 경향이 나타났다. 반면 다수당과 소수당의 이념적 차이가 매우 커져서 소수당이 다수당의 의안을 수용하기 어려울 경우, 다수당 의원들이 이념적으로 크게 이질화되어 소수당의 의사진행방해를 제어할 힘을 보여줄 수 없을 경우, 혹은 자신의 발의로 인해 동료와 조직에 주는 부담이 상대적으로 적어지는 상황에서 소수에 의한 의사진행방해가 훨씬 더 자주 제기되는 것으로 나타났다.
Abstract
Recent years have witnessed many legislative gridlock and even violent acts inside the Korean National Assembly. Many scholarly efforts have devoted to find the ways of internalizing legislative feuds between the majority and the minority parties. The U.S. filibuster is one of the institutional options commonly discussed as a protection of minority rights. However, despite practical importance and public attention given to it, we lack a comprehensive perspective of 'filibustering'―what filibusters are, how they work under which conditions, and what makes senators filibuster against the bills. In this paper we provide an overview of filibusters in the United States and further examine the factors that are associated with the frequency of filibusters in each Congress. Using data from 1917 to 2008 and employing the negative binomial models that allow us to control for over-dispersion problem in the count data, we find that frequency of filibustering in the Senate is a function of intraparty ideological homogeneity among members, interparty ideological heterogeneity in the Senate, and the incentive structure under the legislative institutions.
