Abstract

This study examines how well filibustering is likely to function as a legislative rule of performing parliamentary procedures effectively in the Korea Assembly. To this end, we first look at the U.S. Senate’ use of filibustering, and then research party polarization addressed by ideology and partisan attitudes in legislative behaviors to analyze if the filibustering goes with the current circumstances in the Korea Assembly. In the United States, we identified that the misuse of the filibustering results in reinforcing party strategic advantage as well as provoking gridlock and inter-party conflict in the legislative process, as the two main parties are becoming increasingly polarized. In the same manner, we predict that the use of the filibustering in Korean politics that characterizes with intra-party homogeneity and inter-party polarization will cause the same problems as the U.S. does. Given that the intent of the filibustering is to stop legislative bickering, this paper rather suggests that weakening party discipline and strengthening legislators’ self-determination are prioritized.
