Abstract
This research analyzes the causes and processes that created the European Union's strict GMO regulations based on the precautionary principle. Major causes include policymakers involved in GMO regulations and their relationships, competition and coalitions between interest groups, the structural and institutional aspects that restrict decision making, and the ideas and level of trust that are shared within the society. These factors and the interrelationships between them created Europe's precautionary principle based regulations, distinct from the US and Canada's principle of substantial equivalence; these differences persist to this day. The EU's GMO regulation is an area that demonstrates the European Union's decision making process clearly. The complicated and time consuming decision making process, and the multi-level governance that allows multiple points of veto for the member states may have restricted the adoption of common precautionary principles at the EU level. The policymakers regarding GMO have become highly politicized in Europe. In Europe the producer groups were loosely organized, while NGO groups opposing GMOs were strongly politicized. This is due to the low level of trust amongst the European public regarding supranational institutions charged with regulating technology and food safety. Moreover, the member states was able to involve itself at multiple levels in the regulative-legislative efforts of the EU, and they could reach at effective moratorium on GMO approval through comitology and safeguard clauses. This situation led to external pressure from the US and international organizations in 2003, and WTO settlements accelerated the adoption of EU-wide regulations. Trade conflicts with the US contributed to the member states repealing the moratorium. Regardless, the dispute still caused increased domestic disputes and member states' resistance. Using the trade dispute, civil society organizations demanded more stringent regulations. To establish a stable regulatory framework, the institution in charge must reconcile scientific knowledge and economic considerations along with social trust. In Europe, a distinct social norm regarding GMOs arose during the process of reconciling those two values. This process and precautionary regulation to assure the efficiency of the free market, developed into a strict regulation.
