Abstract

This study analyzes the impact of Artificial Intelligence (AI) technologies on digital creations, with particular focus on two-dimensional visual arts and design, and addresses the accompanying legal and institutional challenges. In recent years, creative paradigms have been reshaped through human-AI collaboration, with AI-driven practices transforming modes of expression as well as production processes. Emerging technologies—including GANs, diffusion models, and text-to-image systems—have significantly advanced the realization of patterns and textures and improved production efficiency, while simultaneously raising complex issues such as copyright disputes and the redefinition of creativity. A comparative analysis of case law and policy trends in the United States, the EU, China, and South Korea, the study confirms that works created entirely by AI are excluded from copyright protection, with recognition granted only when substantial human creative involvement is demonstrably evident. Yet, variations in national legal frameworks and the lack of detailed domestic regulations create uncertainty in practice and heighten the risk of disputes. In response, this research extends conventional copyright principles, authorship criteria, and the doctrine of separability in applied designs to the context of AI-generated works, and further proposes policy measures such as requiring at least 70% human creative contribution, mandatory disclosure of data sources, documentation of creative processes, and the establishment of international guidelines to ensure a balance between technological innovation and legal and ethical standards. The proposed “70% threshold” is presented as a policy guideline rather than a binding norm, intended as a safeguard for creative agency and a preventive mechanism against conflict, with potential refinement through empirical validation and international cooperation, thereby offering a foundational framework for protecting creators’ rights while fostering innovation in the age of AI.
