본 연구는 생성형 AI 시대에서 창작자의 저작권 보호 방안을 모색하고, AI 기반 창작물의 법적 쟁점을 분석하였다. 생성 AI는 대규모 데이터를 학습하여 자동으로 콘텐츠를 생성하며, 이는 창작 과정과 저작권 개념에 혁신적 변화를 초래하고 있다. 그러나 현행 저작권법은 인간 창작자를 전제로 설계되어 있어, AI가 생성한 창작물의 법적 보호 여부와 권리 귀속 문제가 불명확한 상태이다. 이에 따라 본 연구는 AI 창작물의 저작권 보호를 위한 법적 대응과 창작자의 기여도를 증명할 수 있는 체계를 제안하는 데 초점을 맞춘다. 특히, AI와 인간 창작자의 협업 과정에서 기여도를 평가하는 기준으로 창작 과정 기록(로그 데이터, 메타데이터), 수정 횟수와 깊이, 프롬프트의 복잡성과 구체성, 초기 창작물과 최종 결과물 간의 유사성 분석 등의 방법을 제시하였다. 또한, 본 연구는 체계적인 창작 과정 기록을 위한 창작 일지 템플릿을 개발하여, 창작자의 개입을 명확히 증명하고 법적 효력을 확보할 수 있는 방안을 제안하였다. 이 템플릿은 AI와의 협업 과정에서 사용된 프롬프트, AI 모델 정보, 작업 시간, 수정 내역 등을 상세히 기록하여 저작권 분쟁 발생 시 중요한 증거로 활용될 수 있다. AI 창작물 보호를 위해 본 연구는 AI의 기여도가 50% 이상인 경우에 대한 대안적 접근법, 창작 과정 증명을 위한 법적·기술적 기준 확립, 국제적 저작권 보호 체계 구축의 필요성을 강조한다. 특히 AI 기여도에 따른 차등적 저작권 부여, 최소 인간 기여도 기준 설정, AI 개발자와 이용자의 공동 저작권 인정 등의 방안을 제시하였다. 본 연구는 AI 창작물 보호 체계를 정립하는 기초 연구로서 의미를 가지며, 향후 연구에서는 AI와 인간 창작자의 기여도 평가 모델 개발, 블록체인 기반 창작 기록 시스템, AI 창작물 저작권 인증 제도 등에 대한 심층적인 탐구가 필요함을 제안한다.
Abstract
This study explores ways to protect creators' copyright in the era of generative AI and analyzes legal issues related to AI-based creative works. Generative AI learns from large datasets to automatically create content, which is bringing revolutionary changes to the creative process and copyright concepts. However, current copyright law is designed with human creators in mind, leaving the legal protection and rights attribution of AI-generated works unclear. Accordingly, this study focuses on proposing legal responses for the protection of AI-created works and systems that can prove creators' contributions. In particular, it presents methods for evaluating contribution levelsin the collaboration process between AI and human creators, including creative process records (log data, metadata), frequency and depth of modifications, complexity and specificity of prompts, and similarity analysis between initial creations and final results. Furthermore, this study proposes a creative journal template for systematic documentation of the creative process, enabling clear proof of creator intervention and securing legal effectiveness. This template records details such as prompts used in collaboration with AI, AI model information, working hours, and revision history, which can serve as important evidence in copyright disputes. For the protection of AI-created works, this study emphasizes the need for alternative approaches for cases where AI contribution exceeds 50%, establishing legal and technical standards for proving creative processes, and building international copyright protection frameworks. Specifically, it proposes measures such as proportional copyright attribution based on AI contribution, setting minimum human contribution standards, and recognizing joint copyright between AI developers and users. This study serves as foundational research in establishing a protection system for AI-created works, and suggests that future research should delve deeper into developing contribution evaluation models for AI and human creators, blockchain-based creative record systems, and certification systems for AI-created works.
