Abstract
On July 18, 2024, the Supreme Court ruled that same-sex partners should be recognized as dependents of workplace subscribers in the national health insurance. This ruling holds that same-sex partners should also be granted health insurance benefits because there is no fundamental difference between same-sex partner group and common-law spouse group. This study examined the judgment of Supreme Court, focusing on the part of the ruling that determined substantive defects in the National Health Insurance Corporation's guidelines for processing changes in qualifications. The Supreme Court's ruling on the dependent status of same-sex partners is significant in that it is the first ruling in which a court recognized the legal status of same-sex couples, resulting in the inclusion of same-sex partners as spouses and dependents through an interpretation of the National Health Insurance Service's qualification guidelines. As a result of this ruling, other social security laws that define common-law spouses as survivors but do not define same-sex partners, such as the National Pension Act, the Industrial Accident Compensation Insurance Act, and the Employment Insurance Act, will be forced to a situation where they must be recognized as the bereaved in the future. Although the legislator recognized the need to include spouses as dependents of same-sex partners, this omission cannot be considered a legislative error. Therefore, even though same-sex partners form an economic community with the intention of being married, and thus are considered similar to marriage, the provisions for spouses as dependents cannot be applied analogously to same-sex partners. Legal institutionalization, including recognition of same-sex unions as marriage, must be systematically implemented across the entire legal order. However, dealing with individual cases as having individual effects, as in this case, could lead to confusion in the legislative system, and in a situation where there is not yet sufficient social consensus on same-sex marriage, it would lead to legal instability and confusion.
