Abstract
The exercise of the President’s national emergency powers is made possible as an institutional mechanism enabling the President to address such crises and safeguard the constitutional order by exercising exceptional authority in the face of extraordinary circumstances. This system arose from efforts to prevent state power from operating outside the rule of law by anticipating situations where urgent measures become necessary when the maintenance and continuation of the legal order under normal circumstances becomes difficult, devising corresponding countermeasures, and stipulating their requirements and effects. The concern to regulate exceptional situations appropriately in light of the values and principles ordinarily pursued involves complex considerations, as it pertains to the very existence and defense of the state and the constitution. Reflection on situations where judicial bodies assess the constitutional legitimacy of state actions premised on such special and exceptional cases provides an opportunity to consider the significance of politics in relation to the content of the constitution and the role of judicial institutions. Recognition of the substantive meaning of the rule of law demands that all state actions serve to realize the basic rights values prescribed by the Constitution, thereby conforming to the constitutive principles of the governing structure. This realization is particularly expected through the introduction and operation of the constitutional court mechanism. The meticulous pursuit of basic rights discourse and the accumulation of precedents reveal the considerable weight the role of judicial bodies carries in this regard, as witnessed in today’s circumstances. However, the abstract and open nature of constitutional norms demands careful consideration of how recognition and judgment concerning fundamental issues at the national level should be conducted. Reflection and judgment on fundamental constitutional issues cannot be monopolized by the judicial institutions. The foundation lies in discovering solutions through the democratic process of opinion formation, enabled by the free and open expression of views and exchange of information among the sovereign people. It is on this basis that the concrete realization can be expected through the proper functioning of party activities, electoral procedures, and all systems related to the structure and operation of representative democracy.
