헌법과 그의 실천으로서의 헌법재판은 정치성을 기본적 속성으로 갖고 있다. 헌법재판에서는 정치적 사안에 대한 헌법의 적용이라는 과정을 통하여 그러한 정치성이 고도로 드러나게 된다. 헌법재판이 도입된 곳에서는 일반적으로 정치의 사법화 현상이 전개되고 법과 정치의 통섭이 진행된다. 민주화 이후 사법기관의 정치적 역할이 강조되면서 많은 정치적 문제들이 헌법재판기관의 판단을 구하게 됨에 따라 헌법재판의 정치성은 특별히 주목받게 되며 법과 정치의 통섭은 보편적인 현상으로 인식되어 오고 있다. 물론 헌법재판제도를 도입한 각 국가가 처한 사회적, 문화적, 정치적 상황에 따라, 그리고 헌법재판제도의 차이에 따라 법과 정치의 통섭의 양상은 다양하게 전개되고 있다. 하지만 무엇보다도 민주화 과정에서 정치적 결정의 합당성을 검토하는 역할을 헌법재판기관이 수행하며 법과 정치의 통섭이 긍정적으로 이루어지는 양상은 주목할 가치가 있다.
Abstract
It seems definitely unreasonable to ignore the political nature of constitutional law. In constitutional adjudication, the political feature of constitutional practice is remarkably exposed through applying constitutional law to political cases. Wherever the system of constitutional adjudication is introduced and implemented, judicialization of politics has arisen and the consilience of law and politics is made. This development has been accepted as a universal phenomenon because constitutional judiciary has intervened in numerous political hard cases as the political role of judicial branch has been emphasized after democratization. This phenomenon has variation according to social,cultural and political situations in countries which have implemented different types of constitutional adjudication systems. However, it is notable that the consilience has been developed in a positive direction in most countries where constitutional judiciaries have reviewed the constitutional reasonableness of political decisions carefully.
