Abstract

This article reexamines the institution of preliminary and selective co-litigation under Korean civil procedure. Although its introduction was clearly influenced by Japan’s system of simultaneous adjudication action(同時審判申請訴訟), the Korean version has become relatively well established, contrary to initial opposition at the time of its enactment. Several implications can nonetheless be drawn from the Japanese model. First, Japanese jurisprudence does not adopt an expansive interpretation of legal incompatibility between claims; the scope of mutually exclusive substantive claims is more narrowly construed than in Korea. Second, because only the plaintiff may file a request for simultaneous adjudication action, the structure of joinder is simpler in Japan. Nevertheless, the absence of a requirement for uniform adjudication (合一確 定) creates a procedural risk: even when a plaintiff could prevail by appealing only against some defendants, both parties may still risk losing. In this respect, Korea’s legislative requirement of uniform adjudication represents a more advanced development, as Japan continues to require subjective–preliminary joinder even in lower court practice. Third, Japan explicitly defines the timing of a simultaneous adjudication request as the close of oral argument on appeal, a clear statutory formulation that may inform Korean interpretive approaches. Based on these observations, this study draws the following interpretive and legislative conclusions for Korean law. First, preliminary and selective co-litigation should fundamentally be regarded as an ordinary co-litigation. The subjective–preliminary joinder device was designed merely to resolve substantively incompatible claims and thus does not entail joint management or disposition rights as in indispensable co-litigation. The application of provisions on indispensable co-litigation serves only instrumental legislative purposes. Second, the proviso to Article 70(1) of the Korean Code of Civil Procedure should be construed narrowly as an exception to the main clause. Hence, broad application of the main provision and narrow application of the proviso are not unreasonable. Because the proviso concerns the disposition of the object of litigation, it should not be interpreted to include admission of facts (confession).Regarding recognition of claims by defendants, when the principal defendant admits the claim, all claims by the plaintiff are deemed granted, and any remaining claims lose standing. Conversely, if a subordinate defendant admits, the plaintiff’s claim is only partially secured, leaving the litigation pending under the principles of ordinary joinder; in such cases, the court should exercise its explanatory authority (釈明権) to clarify the plaintiff’s claims. If both claims are upheld, conflicts should be resolved at the enforcement stage. Third, the Korean courts have interpreted the concept of legal incompatibility in preliminary and selective co-litigation claims rather broadly. Although this may be justified as a matter of policy, the statutory text alone provides a weak foundation for such interpretation, suggesting that legislative refinement will be necessary in the future.
