Abstract
Throughout the long history of racial discrimination in the United States, various efforts have been made to achieve equality. Colleges and Universities have implemented affirmative action by revising their admissions policies to include students of color who have long been excluded. However, affirmative action in higher education has been criticized for burdening many applicants who are not responsible for the racism that has been a stain on the United States. Questions have also been raised about the true meaning of the constitutional guarantee of equality. To achieve true equality, however, it is important to confront racial disparities and level the playing field. The U.S. Supreme Court has applied a strict scrutiny to determine the unconstitutionality of affirmative action in college admissions and has recognized racial diversity as a compelling state interest. As a result, universities have considered race as one of several factors in the admissions process based on the Supreme Court's ruling. In 2023, however, in Students for Fair Admissions, Inc. v. President & Fellows of Harvard College, the Supreme Court declared that Harvard College and the University of North Carolina's admissions programs violated the Equal Protection Clause of the Fourteenth Amendment and that a diverse student body was no longer a compelling state interest. This article focuses on the Supreme Court's decision that challenged the unconstitutionality of affirmative action in college admissions and reviews the majority’s reasoning of the decision and its implications for higher education admissions policies. Specifically, this article examines the validity of the Supreme Court's decision, focusing on the SFFA decision, which, contrary to precedent, declared racial preferences in admissions unconstitutional, and examines how the SFFA decision changed and affected subsequent college admissions policies. It should be noted that in the absence of full equality, unilateral denial of all preferential treatment is not a true realization of equality, but rather a denial of equality and may result in the perpetuation of discrimination.
